The Construction Industry Payment and Adjudication Act 2012 (CIPAA) provides a statutory mechanism for resolving payment disputes in the Malaysian construction industry. It applies to written construction contracts and allows a claimant to pursue an interim payment award through adjudication — a faster alternative to arbitration or litigation. CIPAA covers disputes on unpaid progress claims, final accounts, and certain back-charges. The adjudication decision is binding and enforceable, though parties may later refer the matter to arbitration or the courts.
When is the right time to seek legal advice on a construction contract?
The most practical point is before the contract is signed. Reviewing draft terms at the tender or negotiation stage allows you to identify provisions that may create difficulty later — particularly around payment schedules, variation procedures, extension of time, and liquidated damages. That said, legal input during contract performance or after a dispute arises can still clarify your position and inform your options.
How long does a CIPAA adjudication typically take?
CIPAA sets out statutory timelines: the adjudicator has 45 working days from the date of response (or from acceptance of appointment) to deliver a decision, though this can be extended by agreement. From initiation to decision, the process generally takes between three and five months, depending on the complexity of the claim and the procedural steps involved. This is considerably faster than court proceedings for equivalent disputes.
What is the difference between PAM 2018 and FIDIC contracts?
PAM 2018 (Pertubuhan Akitek Malaysia) is a Malaysian standard form commonly used for building works. It is developed with local practice in mind and references Malaysian law and institutional processes. FIDIC contracts (Fédération Internationale des Ingénieurs-Conseils) are internationally recognised forms often used for infrastructure, civil engineering, and cross-border projects. They tend to be more detailed on risk allocation and are favoured where international financing is involved. The appropriate form depends on the nature and scale of your project.
